Court fixes date to rule on Ambode’s suit against lawmakers

A Lagos State High Court sitting in Ikeja has reserved ruling till February 27 in a suit filed by former governor of Lagos State, Akinwunmi Ambode, to challenge the constitutionality of the probe of his administration by the House of Assembly over procurement of 820 buses for public transportation.

Justice Yetunde Adesanya gave the date after entertaining submissions from the two counsel, Mr Tayo Oyetibo, SAN, and Olukayode Enitan.

Earlier, Ambode’s Counsel, Mr Oyetibo told the court that the lawmakers should act in line with the provisions of the Constitution.

Mr Oyetibo pointed out that his client is not challenging the power of the lawmaker to investigate but he is saying that the exercise of that power is subject to the provisions of the Constitution.

In a counter-reaction, Lawmaker’s Counsel, Olukayode Enitan challenged the competence and jurisdiction of the court to hear the suit based on three grounds.

Mr Enitan argued that rather than accept the invitation to attend the probe which was issued by the House of Assembly, Mr Ambode rushed to the court.

He, therefore, urged the court to dismiss the suit imminently as is premature.
