Court strikes out order for lack of merit

Justice Baba Idris of the FCT High Court in Nyanya, Abuja has struck out an order of mandamus, compelling the police to release investigation report into the alleged murder of one Helen Okoro for lack of merit.

The deceased was alleged to have been murdered in 2017 at her village in Arochukwu and the suspect was yet to be arraigned in court.

The police were also yet to release the investigation file to the attorney-general of Abia State.

At the ruling on the matter, Justice Idris explained that the court had jurisdiction to entertain the case as against the respondents argument but dismissed the suit since the Police are still on the investigation.

Justice Idris said Order of Mandamus can only be issued when the respondent failed to perform his duties.

Meanwhile, counsel to the applicant, Mr Maxwell Okpara represented by Mr Cyril Nwankwo promised to appeal the ruling.

There were controversial autopsy reports on the alleged killing of the victim in which the police claimed that late Okoro died of high blood pressure but a report conducted by a consultant with the Abuja University Teaching Hospital disclosed that the victim was strangled.
